Any person who was aware of facts which render any assembly an unlawful assembly, intentionally joins that assembly is said to be the member of that particular unlawful assembly and shall be punished with imprisonment of either description for a term which may extend to six months, or with fine, or with both.
Section 144 of the Criminal Procedure Code (CrPC) of 1973 authorizes the Executive Magistrate of any state or territory to issue an order to prohibit the assembly of four or more people in an area. According to the law, every member of such 'unlawful assembly' can be booked for engaging in rioting. Unlawful assembly is a legal term to describe a group of people with the mutual intent of deliberate disturbance of the peace. If the group is about to start the act of disturbance, it is termed a rout; if the disturbance is commenced, it is then termed a riot.
