Essentials For Joint Liability |Indian Penal Code,1860
To attract the principle of joint liability under section 34 of IPC -
there should be some criminal act firstly;
the criminal act should be done by more than one person in furtherance of the common intention of all of them;
the common intention in the sense of a pre-arranged plan between such persons;
participation in some manner in the act constituting the offence by the persons sought to be prosecuted;
physical presence at the time of the commission of all the persons, but the physical presence of all is not necessary in some cases.
